1. The agreement
These Terms are an agreement between you and Memoir™ (“Memoir”, “we”, “us”) for using the Memoir mobile app (the “App”) and the website memoir4u.com (together, the “Service”). By creating an account or using the Service you accept these Terms, our Privacy Policy and our Community Guidelines. If you don’t agree, don’t use the Service.
2. Who can use Memoir
- You must be at least 13 years old, or older if the law where you live requires a higher age to agree to these Terms or to consent to data processing (for example 16 in some EU countries). The App asks you to confirm your age when you sign up.
- If you are under 18, a parent or guardian must agree to these Terms for you.
- You can’t use Memoir if we have previously banned you, or if the law forbids it.
3. Your account
- Give accurate information and keep it up to date. One account per person; don’t impersonate anyone.
- Keep your password and devices safe. You’re responsible for activity on your account. Tell us at once at support@memoir4u.com if you think someone else is using it.
- You can delete your account at any time — see section 12.
4. Your content
- You own what you post — events, messages, reviews, photos, videos and files (“Your Content”).
- You give Memoir a worldwide, non-exclusive, royalty-free licence to host, store, copy and display Your Content only to run the Service — for example, to show an event photo to the people in that event. The licence ends when you delete the content or your account, except for copies others have already saved.
- Photos and files are stored in your own Google Drive and shared by link with the people in the event; anyone who obtains a link can view the file (see the Privacy Policy).
- Only post content you have the right to share, and get permission before posting photos of other people.
- We may remove content that breaks these Terms or the law. We don’t pre-screen everything and aren’t responsible for content posted by users.
5. Zero tolerance for objectionable content and abusive users
Memoir has zero tolerance for objectionable content and abusive behaviour. This includes harassment, bullying, threats, hate speech, sexual content involving minors, non-consensual intimate images, graphic violence, content promoting self-harm or terrorism, scams, and spam. We remove such content and may suspend or permanently ban the accounts responsible, without notice, and report illegal content to the authorities.
Full rules: Community Guidelines and Child Safety Standards.
6. Reporting and blocking
- Report a message, photo or file, review, event or person from its menu in the App (“Report”), or email support@memoir4u.com.
- Block a person from their profile or one of their messages. You won’t see their messages, reviews or media, and they can’t invite you to events.
- We review reports within 24 hours and remove content or ban users who break these rules. Reporting is confidential: we don’t tell the person who reported them.
7. Events and organisers
- Organisers decide who can see and join their events and are responsible for the information they share and for the events themselves.
- Memoir is a planning tool. We don’t organise, host, insure or supervise events, and we aren’t a party to any arrangement between participants (for example travel, tickets or payments). Take sensible care when meeting people and travelling.
- If an organiser deletes an event or their account, the event and its content are removed for everyone.
8. Things you must not do
- break the law, or help others break it;
- post content covered by section 5, or infringe anyone’s copyright, privacy or other rights;
- collect other users’ personal information, or contact people who have blocked you;
- send spam, unsolicited invitations or chain messages;
- access the Service by automated means, probe or attack its security, overload it, or reverse-engineer it except where the law allows;
- sell, resell or commercially exploit the Service without our written permission.
9. Google and other services
Signing in with Google and storing media in Google Drive are subject to Google’s own terms and privacy policy. We aren’t responsible for third-party services, and links to other websites don’t mean we endorse them.
10. Licence to use the App
We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own non-commercial use, under these Terms and the rules of the store you got it from. Memoir, its name, logo and software belong to us; these Terms don’t give you any other rights in them.
11. Apple App Store and Google Play
If you downloaded the App from the Apple App Store:
- These Terms are between you and Memoir only, not Apple. Memoir, not Apple, is solely responsible for the App and its content.
- Your licence is limited to using the App on Apple-branded products you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the App. Contact us for support.
- If the App fails to meet an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent the law allows, Apple has no other warranty obligation for the App.
- Memoir, not Apple, is responsible for addressing any claims relating to the App or your use of it, including product-liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer-protection or privacy claims.
- If a third party claims that the App or your use of it infringes their intellectual property, Memoir, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and not on any U.S. Government list of prohibited or restricted parties.
- You must follow any third-party terms that apply when using the App (for example your mobile carrier’s terms).
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you downloaded the App from Google Play, the Google Play Terms of Service also apply. Google is not responsible for the App or its support.
The App is free. There are no in-app purchases or subscriptions.
12. Ending your account
- You can delete your account at any time in the App (More → Account → Delete account) or on the Delete account page. Deletion is immediate and permanent.
- We may suspend or close your account, or remove content, if you break these Terms, if the law requires it, or to protect users or the Service. Where it is safe and lawful, we’ll tell you why.
- Sections 4 (licence for content already shared), 13, 14 and 16 continue after your account ends.
13. Disclaimers
The Service is provided “as is” and “as available”. To the extent the law allows, we make no warranties — for example that the Service will be uninterrupted, error-free, or that content will never be lost. Keep your own copies of important photos and files (they remain in your Google Drive). Nothing in these Terms limits rights you have as a consumer that can’t be limited by law.
14. Limitation of liability
To the extent the law allows, Memoir isn’t liable for indirect, incidental, special or consequential losses, or for loss of data, profits or goodwill, or for anything that happens at or because of events organised through the Service. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim (the App is free) or INR 5,000. Nothing limits liability for death or personal injury caused by negligence, fraud, or anything else that can’t be limited by law.
15. Changes
We may update these Terms. We’ll post the new version here with a new date and, for significant changes, tell you in the App or by email before they take effect. Continuing to use the Service after that means you accept the new Terms; if you don’t, delete your account.
16. Governing law
These Terms are governed by the laws of India. Courts in India have jurisdiction, but if you are a consumer you can also bring proceedings in the courts where you live, and you keep the protection of mandatory consumer laws of your country.
